1. Who operates this service

Article 10 of the Spanish Information Society Services Act (Ley 34/2002, LSSI) and Articles 11 to 13 of the EU Digital Services Act (Regulation (EU) 2022/2065) require a service like this one to keep certain information permanently, easily and directly accessible. This page is that information. It is not the contract — that is the terms of service — and it is not the privacy policy.

PrePro Selects is a trading name. Every contract for the service is with the entity below, and every other legal page on this site means that entity when it says "PrePro Selects" or "we".

2. Prices, taxes and regulated activity

Prices are published on the pricing page, in euro, excluding VAT. Business customers in the EU with a valid VAT number are invoiced under the reverse-charge mechanism and pay no VAT on the invoice; where VAT is due, it is added at the rate that applies in the customer's country and shown separately. Every payment produces an invoice, available in the app. Nothing is shipped, so there are no delivery costs.

Operating a client gallery platform is not a regulated profession and requires no authorisation. PrePro Selects does not currently adhere to any code of conduct; if that changes, it will be named here with a link to the code.

3. Contact points

Articles 11 and 12 of the Digital Services Act require one point of contact for authorities and one for the people who use the service. Both are answered by a person — never only by an automated system — in English or Spanish, on working days.

4. Representatives in the EU and the UK

If the operating entity is established outside the European Union, three rules oblige it to appoint someone inside the Union who can be addressed instead: Article 13 of the Digital Services Act (a legal representative, who can be held liable for the service's compliance), Article 27 of the GDPR (a representative for data protection matters) and, for the United Kingdom, Article 27 of the UK GDPR. If the entity is established in the EU — for instance because its central administration is in Spain — the first two do not apply and this section says so.

One firm can usually act under both EU rules; a founder resident in Spain may also be designated under Article 13 DSA, accepting the personal liability it carries. The designation is notified to the Spanish Digital Services Coordinator, the CNMC. The UK representative is only needed once there are UK customers or viewers.

5. Where the service runs and which law reaches it

The application, the database, the media storage and the backups run on servers operated by IONOS SE in Germany. They are subject to German and EU law, and to nothing else by virtue of their location. There is no infrastructure outside the EU. The people who administer the servers do so from Spain. The technical measures that protect data at rest are described on the security page and in Annex II of the data processing agreement. What can be exported, and in which formats, is set out on the export formats page (Data Act, Article 26).

The operating entity itself is subject to the law of the place where it is incorporated (section 1). If that place is the United States, a US court or agency could serve legal process on the company for data it controls wherever that data is stored. Article 28 of the EU Data Act asks us to say how we would handle that, so:

  • We act only on legal process that is valid and binding on us. Informal requests are declined.
  • We assess every request for conflict with EU law, in particular the GDPR. Where a conflict exists we do not simply comply: we use the routes EU and international law provide — challenging the request, or directing the authority to a mutual legal assistance procedure — before any data leaves.
  • We disclose the minimum the request lawfully covers, and nothing of another customer's.
  • We tell the affected customer before disclosure, unless the law forbids it, so that they can challenge it themselves.
  • We keep a record of every request and its outcome, and will publish a count on this page once there has been one.

7. This website

The pages of preproselects.com describe the product in good faith and are kept current, but the product changes and a page can lag behind it; the pricing page and the catalogue the product enforces are the reference for what a plan includes. We may take the public site down for maintenance without notice; the galleries and the app follow the availability commitments in the terms. Where this site links to another site, we are not responsible for what that site does.

8. Applicable law

The terms of service state the law and courts that govern the contract with customers; this notice is governed by the same law. PrePro Selects is sold to businesses, so consumer rules and consumer dispute-resolution bodies do not apply. Where a rule of the country in which you are established applies to you regardless of the law chosen, it does, and nothing on this site says otherwise.
